Offer Agreement (Sales Agreement)

§1. General Provisions

This document (“Offer Agreement”) constitutes a public offer within the meaning of Articles 66 and 66¹ of the Civil Code of the Republic of Poland, specifying the terms for concluding and executing sales agreements for products, purchasing artistic services, participating in classes, and acquiring vouchers and gift cards through the Wizards of Art website, operated by:

(“Organizer” or “Seller”).

The Offer Agreement defines the terms for providing services and selling products via the website [website address – TO BE INSERTED], owned by Wizards of Art.
-
The Website Terms and Conditions, Privacy Policy, and GDPR provisions form an integral part of this Offer Agreement.

Using the Website constitutes acceptance of this Offer Agreement and the Terms and Conditions.

The Organizer reserves the right to change the terms of the Offer Agreement, which take effect upon publication on the Website.
§2. Legal Nature of the Agreement

This Agreement is a distance contract within the meaning of Article 2(1) of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827).

The Agreement is concluded without the simultaneous physical presence of the parties, using electronic means of communication, via the Website.

Every person using the Website is obliged to read this Agreement and the Terms and Conditions before making any transaction.

The Offer Agreement becomes binding upon acceptance of its terms by the Client.

Acceptance of the Agreement occurs through:
-
placing an order on the Website and confirming it by clicking the “Order and Pay” button,
-
making full or partial payment,
-
in the case of vouchers — receiving confirmation of payment and reservation.

The Client declares that they have read the Terms and Conditions, Privacy Policy, and Cookies Policy.
-
Failure to accept the terms of the Agreement prevents the use of Wizards of Art services.
§3. Subject of the Agreement

The subject of the Agreement is the sale and provision of services by Wizards of Art, in particular:
-
sale of original ceramic and artistic products,
-
sale of vouchers,
-
enrollment in group and individual classes conducted by Wizards of Art,
-
organization of workshops, artistic events, and themed meetings,
-
other services offered on the Website at a given time.

The scope of services and their detailed description is always available on the Website.
-
Prices of all products and services are quoted in Polish zloty (PLN) and include VAT (if applicable).
§4. Vouchers
-
Vouchers are valid for the period specified at the time of purchase, generally 3 months from the date of purchase, unless otherwise stated in the product description.

Vouchers are personal and cannot be transferred to other persons without the Organizer’s consent.

Vouchers are non-refundable and cannot be exchanged for cash, unless otherwise required by law.
-
In case of loss of a voucher or gift card, the Organizer is not responsible, except if the loss occurred due to the Organizer’s fault.
§5. Moment of Conclusion of the Agreement, Acceptance of Terms, and Rules for Processing Personal Data

This Agreement constitutes a public offer within the meaning of the provisions of the Civil Code of the Republic of Poland (Articles 66 and 66¹ of the Civil Code).

The Agreement is concluded at the moment the Client performs one of the following actions:
-
placing an order on the Website and confirming it by clicking the “Order and Pay” button,
-
making full or partial payment for a product, service, or course,
-
in the case of vouchers — after payment and receiving an e‑mail confirmation.

Upon acceptance of the offer by the Client, a binding sales or service agreement is created between the Client and Wizards of Art.
-
By accepting the offer, the Client declares that they:
-
have read the Terms and Conditions and the Privacy Policy,
-
consent to the processing of their personal data in accordance with GDPR,
-
agree to comply with the participation rules and payment terms.

The Client’s personal data are collected in accordance with the Privacy Policy and GDPR, for the purpose of:
-
fulfilling orders and providing services,
-
issuing invoices and receipts,
-
handling payments,
-
communicating with the Client,
-
conducting marketing activities, if the Client has given consent.
-
Personal data include, in particular: first name, last name, e‑mail address, phone number, payment data.
-
Data are stored for the period necessary to fulfill the agreement and in accordance with applicable law.

The Client has the right to:
-
access their personal data,
-
correct their data,
-
delete their data,
-
restrict the processing of data,
-
transfer data,
-
withdraw consent for data processing at any time — which does not affect the lawfulness of processing carried out before the withdrawal of consent.

Detailed information regarding personal data processing is provided in the Website’s Privacy Policy.
§6. Effective Date of the Agreement

The Agreement comes into effect upon the Client’s acceptance of the offer, which occurs at the moment of placing an order or making payment for a product or service on the Website.

The moment the Agreement comes into effect is the moment at which mutual rights and obligations between the Client and Wizards of Art arise, including the obligation to provide services or deliver the product and the obligation to make payment.

The Client is obliged to verify the accuracy of the order and the data provided when placing it. The Organizer is not responsible for errors resulting from incorrect data provided by the Client.
§7. Payment Terms

The available payment methods on the Website include:
-
Fondy (card payments, BLIK),
-
Stripe (international payments),
-
PayPal,
-
Apple Pay,
-
Google Pay,
-
traditional bank transfer (if this option is provided).

All payments are made in Polish złoty (PLN), unless otherwise indicated during the purchase process.

After placing an order, the Client receives a purchase confirmation and an invoice or receipt in electronic form at the e‑mail address provided during the order.
-
Payment is considered completed at the moment the transaction is confirmed by the payment operator.
§8. Force Majeure

The Organizer shall not be held responsible for the non-performance or improper performance of the Agreement if it is caused by circumstances beyond the Organizer’s control, including but not limited to:
-
natural disasters,
-
actions of public authorities,
-
technical failures,
-
pandemics or other random events.
-
In the event of a force majeure, the Organizer will inform the Client about any changes in the provision of the service or the refund of payments.
§9. Order Cancellation and Refunds
1. The Customer has the right to withdraw from a distance contract within 14 days of receiving the product or confirming the service, in accordance with the terms set out in the Returns and Complaints Policy.
2. In the case of workshops, courses, and artistic classes, withdrawal is possible under the terms set out in the Terms and Conditions (§ on the rules of participation).
3. Refunds will be made using the same method used for payment, unless the Customer expressly consents to a different method.
§10. Document integrity

This Offer Agreement constitutes an integral part of the entire set of documents governing the use of the Wizards of Art Service, including in particular:

Terms and Conditions,
-
Privacy Policy and GDPR (with the Cookies Policy),
-
Returns and Complaints Policy,
-
Accessibility Policy,
-
Payment and Delivery Policy
-
Acceptance of this Agreement signifies full consent to all the other documents listed above.
§11. Liability and Disclaimers

Wizards of Art undertakes to provide services with due diligence, in accordance with applicable law.

The Seller is not responsible for damages resulting from errors in data provided by the Client, incorrect email addresses, payment errors, or failure to collect a shipment.

In the case of courses and workshops, Wizards of Art reserves the right to:
-
change the date of the classes due to reasons beyond its control (e.g., instructor illness, force majeure),
-
cancel the event and refund the amounts paid.
-
Any disputes arising from the execution of this Agreement will be resolved amicably in the first instance, and if no agreement is reached – by the court competent for the Organizer’s registered office.
§12. International Clause

This Agreement is also binding for Clients from outside Poland, in particular from European Union countries.

In case of differences in legal provisions, the law of the place where the service is provided shall apply, unless national law imposes other obligations.

The foreign Client undertakes to comply with the provisions of this Agreement and the Terms and Conditions.
§13. Final Provisions

This Offer Agreement is effective from the date of its publication on the Service.

In matters not regulated herein, the provisions of Polish law and applicable European Union regulations shall apply.

Any disputes arising from the Agreement shall be resolved by the court competent for the Organizer’s registered office.
-
The Service Terms and Conditions, Privacy Policy, and Cookies Policy are an integral part of this Agreement.
-
The Agreement is available in Polish; its translations into other languages are for reference purposes only.
